Welcome to Gotham Literature (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website, content, and services (collectively, the “Services”). By accessing or using Gotham Literature, you agree to these Terms. If you do not agree, do not use our Services.


1. Use of Our Services
1.1 Eligibility
You must be at least 13 years old to use our Services. If you are under 18, you may use our Services only with parental or guardian consent.
1.2 User Conduct
You agree not to:
   •    Use our Services for any unlawful purpose.
   •    Interfere with or disrupt our website or its security.
   •    Attempt to access another user’s account without permission.
   •    Post, submit, or share any content that is defamatory, infringing, obscene, or otherwise objectionable.

1.3 Account Registration
Certain features may require you to create an account. You are responsible for maintaining the security of your account and for all activities under it.
2. Content & Intellectual Property
2.1 User-Submitted Content

Submissions of creative work to Gotham Literature are governed by a separate Writer Agreement, which contributors must review and agree to prior to publication. The most up-to-date Writer Agreement can be found on the website’s Submit page (GothamLiterature.nyc/submit).

2.2 Our Content

All content on Gotham Literature — including the website design, logos, editorial content, and graphics — is owned by us or used with permission. You may not copy, reproduce, or distribute this material without express permission.

Published creative works (such as fiction, nonfiction, poetry, and comics) remain the intellectual property of their respective authors and are published on Gotham Literature under a license granted by the author. Gotham Literature does not claim ownership of submitted works; copyright remains with the author. We publish these works under a license granted by the contributor as outlined in the Writer Agreement, which can be found on our submissions page.

These works may not be reproduced, distributed, or republished in full without the author’s permission, unless otherwise explicitly stated.

Sharing and Quoting

You are welcome to share direct links to any page or piece published on Gotham Literature.
You may quote brief excerpts (typically up to 250 words or a few lines of poetry) for non-commercial purposes such as reviews, academic writing, or social media, provided that:
   •    You clearly credit the author and Gotham Literature
   •    You include a working link back to the original page
   •    You do not modify the excerpt in a way that misrepresents the author’s intent

3. Payments & Subscriptions
3.1 Payments to Writers

Payments for accepted submissions are governed by a separate Writer Agreement, which contributors must review and agree to before publication. This agreement outlines payment terms, licensing, and rights, and may vary depending on the type of submission, method of solicitation, or revenue structure in place. The most up-to-date Writer Agreement can be found on the website’s Submit page (GothamLiterature.nyc/submit).

3.2 Refund Policy

Subscription payments, if applicable in the future, are non-refundable except where required by law.  Any future subscription offerings will include clear terms at the point of purchase.

 

4. Termination

We reserve the right to terminate or suspend your access to our Services if you violate these Terms.

5. Disclaimers & Limitation of Liability

Our Services are provided “as is” without warranties of any kind. We are not liable for any direct, indirect, or incidental damages resulting from your use of Gotham Literature.


6. Copyright Infringement & DMCA Policy

Gotham Literature respects the intellectual property rights of others. If you believe that content published on our website infringes your copyright, you may submit a Digital Millennium Copyright Act (DMCA) takedown notice by providing the following information in writing:
   •    A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
   •    A description of the copyrighted work you believe has been infringed.
   •    A description of where the infringing material is located on our site (a URL is helpful).
   •    Your contact information, including your name, address, telephone number, and email.
   •    A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
   •    A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

Upon receiving a valid DMCA notice, we will review the claim and, if appropriate, remove or disable access to the allegedly infringing content. We may also contact the original submitter to inform them of the claim and, where applicable, allow them to submit a counter-notice in accordance with the DMCA. Content may be restored if the submitter provides a valid counter-notice and the original complainant does not pursue legal action within the timeframe required by law.


7. Governing Law

These Terms are governed by the laws of New York, USA. Any disputes must be resolved in the courts of New York State.


8. Changes to These Terms

We may update these Terms from time to time. The latest version will always be posted on our website.
